1. Scope of validity and warranty
1.1. This warranty only applies to end customers/system operators of PV systems who have purchased products of the Magic PV substructure product group from OBO Bettermann Produktion Deutschland GmbH & Co. KG (hereinafter “OBO”) for personal use.
The warranty is valid regardless of whether they were manufactured by OBO or an affiliated company.
1.2. This warranty does not extend to intermediaries, resellers or subsequent purchasers.
1.3. The warranty applies throughout the European Union and in countries where the products were first placed on the market by OBO.
2. Scope of warranty
2.1. OBO guarantees that Magic PV substructures sold under the OBO name are free of material and manufacturing defects that could impair the stability or function of the components.
2.2. Metal components: 25 years from delivery to the end customer
Plastic parts (load-bearing parts, no rubber parts): 12 years from delivery
Rubber or elastomer parts are entirely excluded from the warranty.
2.3. The warranty only covers repair or replacement delivery of faulty components. Other costs, in particular for removal, re-installation, transportation, indirect damage, other mounting work or lost profit, are not covered and shall be borne by the customer.
3. Warranty services
In a warranty case, OBO shall provide either a free repair or free replacement delivery for the faulty component, at its own discretion. A replacement delivery also includes the delivery of an equivalent component that meets the function and quality of the original part in full.
4. Warranty requirements
4.1. The products must be installed, operated and maintained properly in accordance with the installation, operating and maintenance instructions provided by OBO.
4.2. The warranty stipulates that the products only be used for their intended purpose.
4.3. Damage due to external influences, force majeure, improper transport, installation errors by non-authorised third parties, vandalism or excess loads is excluded from the warranty.
4.4. The warranty stipulates that the relevant Magic PV substructure be created using the OBO Construct planning tool for photovoltaic mounting systems and installed in line with the resulting technical and static requirements, including final verified project approval; otherwise, the warranty shall be excluded.
5. Warranty claims
5.1. The end customer shall notify OBO in writing (letter, e-mail) of production-related defects promptly, within six weeks of discovery at the latest.
5.2. The following information shall be included in the complaint:
- End customer contact data
- Date the system was commissioned
- Project or order documentation
- Technical and static planning documents from OBO Construct or equivalent planning software
- Photo of the defect (entire system and close-ups)
- Proof of purchase/invoice
5.3. Defective components may only be returned following written approval of OBO.
5.4. If the customer fails to report a defect in time or provides incomplete information, the warranty claim shall be voided.
6. Warranty exclusions
6.1. The following are excluded from the warranty:
- Damage due to improper mounting or maintenance
- Damage due to external influences, forces of nature or force majeure (e.g. wind, flooding, fire, earthquake)
- Damage that is covered by natural hazard insurance or that would normally be insurable
- Wear, visual defects, e.g. cutting edge protection corrosion or ageing
- Products that were not used properly or that have been combined with parts belonging to other systems
- Lack of proof of use of the OBO Construct planning tool for photovoltaic mounting systems
6.2. Rubber and elastomer parts, as well as non-load-bearing plastic parts (mounting aids, pads, seals) are expressly excluded.
6.3. Indirect damage, subsequent damage or lost profit shall not be replaced.
7. Warranty services
7.1. In a warranty case, OBO shall at its own discretion choose between:
- Repair of the faulty component
- Replacement delivery of the faulty component
7.2. The warranty only extends to costs for the product itself, not to mounting, transport or other follow-up costs.
7.3. The provision of warranty services shall not extend the original warranty period.
8. Miscellaneous
8.1. This warranty shall apply in addition to the legal warranty rights, which shall remain unaffected.
8.2. The warranty is a voluntary service of OBO and does not give rise to any further obligations.
8.3. Choice of law: This warranty shall be subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
8.4. The place of jurisdiction for end customers is the customer’s place of residence; for traders or corporate bodies, the exclusive place of jurisdiction is Menden, Germany.
